    exactly. i feel the same. this thread however happens to be about a tenant not paying their rent and not a homeowner not paying a mortgage
    It's about a tenant being late with the rent, not a tenant not paying at all. There is quite a difference between late payment and non-payment.

    Ifb a tenant stays in accommodation and knows that he is never going to be able to pay his rent he is committing criminal offences. Why should a landlord have to put up with criminality?
    And what about a landlord that relies on the rent, to pay the mortgage and has no money put aside for repairs or can't pay the management fees?
    He really is committing the criminal offence of fraud, as he defrauds the tenants of his money without providing the full service (a serviced apartment with managements fees fully paid up).

    no. it really is very simple. its about a tenant not paying rent. being late would be 1 or 2 days, not 6 weeks

    Clutch at straws much? Apart from the fact that there has been no mention of any landlord failing to do repairs, there's a hell of a difference between having a couple of hundred set aside for repairs and maintenance and losing out on six weeks rent, not knowing when you'll see a penny.

    The can be concurrent civil and criminal wrongdoing. There can be both civil and criminal actions for assault for example. There can often be civil and criminal actions arising out of motor crashes. The same situation can arise with respect to landlord and tenant issues or indeed even failure to pay in a Restaurant.
    There is a specific criminal offence of failing to comply with a determination order of the PRTB.
