Working in the USA for a year (Partner's Visa)

    Hey guys and gals,
    A friend of mine is living and working in San Francisco. He lives there with his girlfriend who is an American citizen. I recently visited him and he's trying to convince me to move over for a year (or more!).

    He reckons he could get me a job no problem that would include a working visa. He, like myself, is an automation engineer. The company that he's working for are crying out for people over there apparently.

    My question is about my girlfriend. She's a primary school teacher here at home. What would her visa situation be? Could she get a working visa for a year? Could she work on my visa? Any help would be appreciated.

    She could only get a visa on her own steam - there is nothing for girlfriends...only for wife/husband/civil partner

    The other thing is - it would also depend on what visa you would be able to for you. The most likely is the H1b visa - this would allow you to work, but would require sponsorship by the company. There is nothing you can apply for yourself. There are only a set number every year (20000 IIRC).They are granted every April, and you have to move in the October.

    The other thing is...if you are H1b...your wife cannot work. She can study at a college but that is it

    Have they change the H1B rules? When I worked there my Mrs. had one and I had a separate one

    you mean you had a H1b as well or an accompanying/dependent visa?

    All the h1b's that I know have their partners in on h4 visas which is the "Dependent visa" for that category.

    H1Bs can grant partner visas, but they do not have the right to work. If you and your partner count as 'specialised workers', you can both get one.

    I'm here on an L2, my husband's an L1 (intra-company transferee) and I have the right to work, although it takes a few months to come through. If he had an H1B, I wouldn't have the right, and am not qualified as a specialist myself.

    Also, I don't know how 'girlfriend' counts in visa terms - think it might need to be spouse/civil partner.
