Tenant vs Licensee when Owner is Resident?

    Hi, is it true that the tenant vs licensee thing you often hear about with a live-in landlord is BS?

    IE someone who rents a room in a house where the landlord is resident aswell has all the same rights and cant be kicked out with 48 hours notice or have their rent raised whenever etc?

    I always believed if you had a live in LL then they could kick you out whenever they felt like it, has this changed recently or has it always been the case?

    It hasn't changed. Licensee's have very little to no rights in comparison to a tenant who holds a tenancy agreement.

    It depends on the licensee agreement.

    However, it's true that a person under a licensee agreement usually won't have the same rights as a tenant.

    Statutory tenants rights don't apply and there is no guidance on what could be considered appropriate notice. HOWEVER, a written licence will assist in these circumstances - even if titled and modelled on a standard lease or tenancy agreement - and can give the rent payer a greater level of comfort.

    The usual rule of thumb in these instances is the notice period is the same as the the period of rent payment: weekly rent, one-week's notice. This is in no way legally enforceable though.
