I think it's rather rich that someone with no insurance is trying to claim off the policy of someone who has! The problem here is that the car wasn't insured. The fire wasn't the other guys fault and that the second car wasn't insured isn't his fault either.

In fairness, right or wrong, (before I read this thread I suppose) if my car was damaged by a car catching fire adjacent to it then the first question I would be asking also is does their insurance cover me. No doubt I wouldnt like the answer I got, but Id certainly be exploring all avenues before involving my own insurance.

If it happened to yourself and you had insurance then whether you lose your ncb or not you still wouldn't like it,I've come across you on boards on numerous occasions and you seem to have a good head on your shoulders, my friend a grandmother in poor health who wasn't in a position to renew her insurance on health grounds, if the shoe was on the other foot would you still have the same attitude or would you seek anyway possible to recoup your only source of independence???? Hers is now gone due to a combination of a stupid teenager and equally bad parents for backing him

I'm afraid I would. It isn't the neighbours fault. I'd go after the lad and his parents but the neighbour has enough problems without me blaming him by trying to claim on his policy.

On a related note, in the case of a thief stealing a car, heading off down the road and crashing into someone with it, on the basis of what we have heard above, the stolen cars insurers wouldnt pay out as the car owner did nothing to cause this and wasnt negligent or responsible in any way. I think its clear that they do pay out.

    Isn't this covered by MIBI?

Hard to believe the insurer would pay out when the driver (thief ) had no policy at all?

Usually the insurance company administers the claim as insurer concerned but they would recover from the MIBI. There are exceptions to the recovery, such as if the policyholder was negligent by leaving the keys in the car

It's great to be in a position of knowledge.

If you has presented this situation to me before I read the thread my first reaction would be to see if a claim can be made on the insurance of the car that was set alight. Im sure almost everyone who didn't know the score that world be their first question also. You can't blame the owner for at least finding out where they stand.
