Given 4 weeks to move out?

    Our letting agency have given us a month to vacate our rented house (three tenants). We got written letter in the post during the week to advise we have to vacate the premises by the end of October. After calling the agency, I found out that the banks are forcing the owner to sell so as a result they need us to vacate to facilitate the sale. Just a query…. Ive been living there 4 years and the other tenant more than 8 years, the third tenant has only been there a year. We know legally we should be given 16 weeks notice to vacate (if in tenancy 4 years plus) but in this instance with the banks involved what happens or what can we do? The letting agency explained that they’re as much victims as us the tenants… but what rights do we have? Just concerned I won’t be able to get a place to live in 4 weeks! There is a chance that the house could be bought by an investor who wants tenants in place but its a family house so unlikely.

    I believe you have between 35 days to 84 for 4 years and 112 for over that according to threshold.

    Just wondering do we need to contact the bank selling the property as opposed to the letting agency? Letting agency seem to be wiping their hands of the situation.

    Do you know if the bank has actually foreclosed, or if they are just pressuring the LL to sell?

    Who are you paying the rent to these days?

    Currently paying rent via letting agency, the rent due out tonight for the next month. Letting agency said the banks are forcing owner to sell but I didnt get much more detail that, unsure if there is pressure to sell or it has already been foreclosed. All we were given was the 'vacate by October 31st'.

    So my understanding is that... banks can basically tell us to get out despite the length of our tenancy? really sh/itty situation.

    The bank forcing the owner to sell is not the same as a receiver being appointed, so you may want to point out the minimum notice periods to the letting agent and tell them to back off as the landlord is still technically in charge and the lease is very much active and enforceable.

    Refer it to PRTB. Don't move out in 4 weeks.

    Dig your heels in, there could be a lot of rent free living in your future if you're dealing with a bank...

    Meeting with letting agency later so will have an update then but its so frustrating! :(

    update, letting agency *insert expletive* have basically been lying saying that house is being repossessed, am guessing it was an endeavour to get us out asap etc. The truth is that the house is being put up for sale by the landlord via the same agency.

    We stated the law is on our side, we are entitled to 16 weeks notice. We have put everything into writing but they are a shower of *insert expletive*. They wanted to know if they can show the house whilst we are in tenancy so hmmm… starting to look for alternative accommodation but grrr.

    Don't do them any favours, because they certainly won't do you any.

    That house is now a giant €€€ to them. You are nowhere near their list of concerns. Dig your heels in and take every right that is available to you.

    The gall of some people. And these clowns call themselves professionals....

    So they try to strong arm you and force you out under a complete falsehood then turn around and ask you to accommodate them as they show the house while you're in situ.

    I wouldn't play ball in the slightest and I'd be very much tempted to lodge a complaint with the PSRA based off their "business" practices. Honestly OP, they'll just keep doing it to people if you don't complain. And unfortunately some people will just roll over and take it because they don't know any better.
