Do we have to sign a renewed fixed term lease?

    Hi there,

    We have been renting our place since Aug 2012. We have been looking at houses recently and are going through the process of buying a house. We haven't told the landlord yet in case things fall through but will give him adequate notice.

    Our fixed term lease was up in august but we never heard anything from the letting agent til we got a new lease to sign in the post last week.

    Am i right in thinking we can give them a call and say we don't want to sign a new one and leave it as a part 4 tenancy which is a rolling one?

    We will also be telling the landlord soon (as we deal with him re issues/repairs etc) about the house all going well of course.

    You're already on a Part 4 since they didn't renew the lease when it expired. You don't have to sign the new lease, but have a talk with the landlord about your plans now since the lease has arrived. You're now in the period where you must give 8 weeks notice of intention to leave.

    Only sign the lease if it suits you. It would appear it doesn't.

    Tell the landlord that things (don't explain if you don't want) are up in the air at the moment and that for the moment you want to stay on under Part 4 of the Residential Tenancies Act 2004.
