Refusal of rent allowance after lease has been signed

    Hi all

    Just looking to see if anyone has information that might be able to help.

    My girlfriend recently had to move apartment and has found a new place but it is several hundred euro more expensive every month. Sh has already moved in, paid her deposit and paid her first months rent. She has since been to the social welfare who have approved her and are happy to help her out with assisting in covering the balance since she moved but now her Landlord is refusing to accept the rent allowance and is threatening eviction if she can't meet her payments.

    Is this legal? Can he refuse to let her pay with the help of a rent supplement seeing as she already has a signed lease and is registered with the PRTB? Surely it is no skin off his nose if she gets any assistance once he gets paid in full and on time?

    My girlfriend is in an awful way worrying now with Christmas just around the corner as she has a young daughter too and doesn't know what is going to happen?

    Did the landlord know that she'll be getting part of the money from Rent Allowance before she moved in?

    Your girlfriend has changed the terms of the lease by putting rent allowance into the equation. Did she tell him she was going to be using rent allowance to make the payments?

    No she only applied for it once she had already moved in

    It is perfectly legal. Landlords have zero obligation to agree to RA/RS. There are good reasons for not accepting it(what if the government changes the rates so suddenly the tenant can't afford to pay any more? / more paperwork/hassle etc.).

    Most ads these days specifically say they don't accept rent allowance. Did your girlfriend not bring up that she was intending to use this? Extremely bad form is she didn't.

    The LL is not agreeing to RA(as is his right), therefore she needs to cover the cost of rent herself. If she can't pay the rent of course she will be evicted. Seems very clear to me.

    The landlord is well within his rights to refuse rent allowance.

    Its up to the landlord whether they want to accept it or not. They have to sign form and provide documents etc in order for it to be processed and if he doesn't want to accept RS he just wont provide what's needed on the form.
