Does anyone know if our Venezuelan au pair can extend her visa? Her visa expires in February as she will have been in Ireland for one year at that point.
I have heard there are some changes to the legislation in this area coming in the new year. She has been with us for 3 months and we all want to extend the arrangement if we can.
    Many thanks

a non-EU national can only work as an au-pair as long as they are attending a full time, year long course (minimum 15 hours per week for a minimum of 25 weeks).

So for your Venezuelan, assuming she is a student at the moment, the next question is how long has she been here? You say she has been here for 1 year, that means she can study for a further 2 years on any course that is below NFQ level 7 (NFQ = National Qualifications Framework).

Once a non-EU student has been studying below level 7 for 3 years they can only go on to a level 7 (degree level) course.

The changes that are coming in relate to dealing with the abuse of the system by the dodgy schools that have been closing down, but they primarily relate to the type of school and course that a student can attend or study, they do not change the regulations concerning the amount of time someone can be a student or what they need to do to extend their permission to remain as a student.

For your specific situation, your au-pair can register to take a course at an approved school in February and extend her permission to remain that way (I am assuming that she is registered as a student already and has adequate attendance on whatever course she is doing).
