Buying a house appliances

    Just a quick question, we are in the process of buying a house, when we met the estate agent he said all integrated appliances (dishwasher, oven and hob) and we would negotiate around the other appliances (fridge / dryer / washing machine). Our solicitor just send the contents list there and they are taking them all now... Is there anything we can do?

    If they were listed as part of the sale and now taking them with I'd submit a new offer minus the cost of the bits they are taking.

    Other than that not much you can do.

    While its not a hard rule, in general anything thats screwed in is considered part of the house, so normally built-in appliances would be included. Free standing appliances would normally not be included unless specifically listed as being part of the sale.

    are they taking the integrated too? Sorry its not clear, get your solicitor to bject if thats the case as the esate agent told you they were included.

    If you're in any doubt about what is/is not being included on the day you take charge of the house, you need to instruct your solicitor to communicate what you want to the vendor's solicitor at which point it may or may not become a point of negotiation. Either way, the important thing is to have in writing the agreement so that both parties are sure of their obligations.

    This does not have to be in the contract of sale, it can be in the form of a written letter of agreement between both parties, via their solicitors, or a verbal agreement, but if it involves a lot of money or you really want them, you can have it referred to in the contract of sale. While it seems sensible that built-in items might be included in the agreed price, it's always sensible to be clear on whether or not the price includes, at least, white goods or not and it's not unheard of for vendors to want to take their built-in kitchen with them!

    Either way, you should get this advice from your solicitor about the pros and cons of going a particular route. If they want to take everything with them, then you need to factor in the cost of a new kitchen and, if you think it's worth it, negotiate in relation to that cost.

    In our case, we had requested, during correspondence with the vendor's solicitor that all carpets should be removed and disposed of. This was not picked up by the vendor's solicitor. Our concern was to not incur the expense of removal and disposal. Our solicitor asked if we wanted to make this legal in order for it do be done, but in the end it was settled verbally. All other requested items to be kept were left in the house as agreed. We had no money left, so we held on to their 30 year old cooker and fridge until we could get around to renovating.

    It is the integrated appliances (dishwasher, oven, hob, microwave, freezer) and also the "free standing" fridge, washing machine, dryer.

    We have spoken to our solicitor and he said without it been written somewhere we basically haven't a leg to stand on. He said yes the estate agent was in the wrong and shouldn't have mislead us but we still can pull out as no contract has been signed... We really don't want to, we like the house but it fells really bad form the vendors are doing this.

    is the estate agent denying it now or sayign they changed their mind. I assume its not on web advert or brochure?

    The estate agent said it wasn't written in the brochure and that's all thats important... the family can take what they want as long as it wasn't listed.
