employment contract question

    I've just finished a one year contract and have been given my second one. Now my first one officially finished on Mon Jan 26th but i see my new one starts on Fri Jan 30th. This seems a bit odd especially as i have to be offered a permanent job if i have three years continuous employment. Should i be concerned?

    You should be concerned. Its not unknown that some employers use that type of ruse to try to avoid giving permenancy. Do you think yourself that they would try that stunt? In any case you should query it and point out thatr you worked continuously an that the 2nd contract should start the first day after the 1st contract ended.

    I may be more concerned about working for nearly a full month without having any contract at all in place?

    You can be employed on a series of fixed term contracts for up to four years, not three. There is nothing to stop you employer doing this but there are a couple of requirements which must be fulfilled. Your employer must inform you in writing as to why you are being offered another fixed term contract rather than a permanent one. They must inform you (general announcement will do) if a permanent position opens. They must have certain clauses in the contract which are particular to FTC's. You need not be concerned at all about the "missing" week, a break between contracts only becomes relevant if it is over 3 months.

    Just google "fixed term contracts" and you will get all the info you need.

    Cheers Davo, another query, i was send two copies of the contract one for me to sign and return and an employer copy but neither was signed by the employer and the contract states that it does not become operational until signed by the employer yet i have no way of knowing if they sign it or not. Should i request conformation that they have signed it?

    That is normal. The offer is made by the employer and signed/accepted by the employee. It becomes valid from the date you signed it. They will return one copy to you, ideally you would photocopy the contract and your signature before giving them back to employer to ensure no changes are made.

    Don't be concerned Rockfish, everything you have posted is typical of how fixed term contracts work. At the end of this one though, they have to either make you permanent or let you go.
