I would. If he is very emotional, that is fair enough. But if he got mullered out of his brain, when he knew he was going on national TV later on, it is disrespectful to the the show host, his fellow guests, the LLS audience, as well as the memory of the man that he is going on the show to talk about imo.

I don't know what qualified him to be a judge, but you could say the same about tonights panel.
