Rodent issue - who is liable

    Quick one for you all-

    In a managed complex setting- where there is a communal sewage pipe network shared between multiple units- who is liable if rodents attempt to enter a property via the sewage piping, and cause significant damage to a few units?

    Is it the Management Company- or failing the Management Company- is it the duty of the property owner to remedy the issue?

    The damaged units are all owner-occupied- not that that makes much difference.

    What would ye expect in a situation such as this?

    (Type of damage = damaged main piping, damaged internal masonry walls (wet damage), damaged en-suite bathroom in one unit (completely out of commission etc) additional vents necessary in one unit).

    I think it is the responsibility of the mgmt company to resolve the rodent issue and fix any damage to sewage pipes etc.

    However, I think fixing damage to individual units lies with the owner, or their insurance company.

    Unless you have a situation where it could be argued the mgmt company was negligent in taking action - long delay in addressing issue after it was raised etc - but that could be a mess.
