Delay by Insurance Company

    I was involved in an accident 7 weeks ago today. Minor damage done by both cars.

    Rand and explained the situation to my insurance company. They suggested that, given my account, that my best course of action was with the other parties insurance company. I have been dealing with them ever since.

    The other parties insurance company have confirmed and agreed the events occurred as I said/as the other party has said. Given the established and agreed facts the liability falls on the other party.

    Despite all this I can not get the insurance company to either accept the claim or progress it. I keep being told that there is no update and that the claim is with the loss adjuster.

    I feel that this delay is to long. I have made a complaint to the insurance company but nothing has been done about it.

    Is there anything else I can do? I am close to my renewal and would prefer not to have a black mark against my policy.

    You need to get your insurance company to fight it out with the other party's insurance company. That's what I had to do and sorry to say it took 9 months. Renewal was in the middle and I couldn’t change company as nobody will touch you with an open claim. So my renewal was huge because my ncb was stepped back but when everything was sorted I got a nice refund.

    It appears that the other insurance company is delaying this on purpose.

    My claim will be approx €3k but you would swear its in the millions

    It took my company sending a court date to the other before they settled. Fault was not at question but like you I felt the other company did it on purpose.

    OP you appear not to be claiming off your own policy, you are claiming off the other motorists insurance.
    In this case you do not have an open claim on your policy.

    Have they accepted liability?

    Have they offered to repair your car at their approved repairer?

    Just indicate you intend instructing a solicitor which that will result in unnecessary legal costs, if claim not settled within 14 days.

    Firstly, if you are claiming directly from the 3rd party's insurer, your own insurance company will not get involved. They can only do this if they are defending a claim against you or if they have paid for your damages and are seeking recovery.

    I cannot understand a 7 week delay, where liability is agreed. Are you disputing their offer or is there an injury claim going on? If everything is straightforward, there are solicitors who specialise is representing you against the insurer. They don't charge you a fee or take a cut of the settlement. They bill the 3rd party's insurer. PM me if you need details
