    From the picture in the OP it looks like the cars, which aren't shackled, smashed into the HGV as the HGV is sitting in the middle of the lines with its trailer still straight. If the HGV got loose it could have been much worse.

    Mate of mine was coming over from holyhead on Tuesday night and they hit a storm and he said the boat was being thrown around like a rag doll, people getting sick everywhere said he was genuinely ****ting it

    Looks like one HGV flipped alright, but the majority of the damage looks like cars hitting other vehicles and some loads falling. If a few HGVs got loose the ship would have been in much more trouble.

    I think it's fairly straightforward under maritime law that the ship owner is liable for damages to cargo.
    Storm damage to a ship would never be considered an act of god or an uninsurable risk.

    Ports aren't always the safest place, depending on the nature of the storm and the layout of the port. Sometimes natural headlands and other features would provide greater protection, there's been plenty of ships damaged in port during storms. It's not unheard of for ships to leave port to weather out a storm in an area that offers greater protection from.

    That doesn't mean it was the right call by the captain in this instance, and if he thought port wasn't safe for the ship, then maybe he should have left the passengers behind in the first place when he chose to leave.
