Laneway taken in charge by Dublin City Council

    Afternoon,

    Does anyone know if a laneway (at rear of properties) is taken in charge by Dublin City Council years ago (but not owned by Dublin City Council) is it covered by Dublin City Council public liability insurance?

    In theory, it would be. However, note that councils are only responsible for misfeasance / malfeasance, not nonfeasance. Councils are insured by a mutual.

    As to whether the lane was taken in charge properly might be another matter.

    Any claim should proceed carefully.

    Depends. Some lanes have all the council services, lighting etc but are not taking in charged, and are still private. Charlemont Lane in Clontarf for example.
