Quick Rent Question

    Myself and my wife have been renting an apartment since 2013. Our landlord increased our rent last year (2015). With the new law in place, our rent cannot be increased this year.

    Two Questions
    Could our landlord tell us they need their apartment back, therefore allowing them to re-list at a higher price? (our rent was increased before the new law was known - April 2015).

    We have been renting the apartment for nearly 3 years. What notice would our landlord have to provide if they were to do the above?

    After 6 months occupancy you gain certain rights commonly known as part 4 rights.

    Putting it simply, under Part 4, if the LL wants the property back, they can only do so for certain reasons. The most common three are wanting to sell, wanting it for themselves or family member, major renovations.

    If the property is subsequently put back on the rental market, the LL is supposed to offer it again to you, and again simply put, under the same criteria that was in place when they terminated your original tenancy.

    If they don't do this you can take it up with the PRTB as this can be construed as an illegal eviction by the LL.

    Part IV rights reset on a 4 year rolling basis- and for the first 6 months of a new cycle a landlord could ask you to vacate the tenancy- without giving you any reason whatsoever (they would however have to give you the requisite notice).

    If you've now been there for 3 years- and are safe from a rent increase for a further year- once the clock ticks round (12 or 14 months hence) the landlord can simply end the tenancy- and relet it immediately to another party for whatever they decide.

    Its one of the downsides to the 4 year cycle that Part IV tenancies operate on- however- there are numerous upsides too- and in general- the pros vastly outweigh the cons from a tenant's perspective.
