Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back a page or two to re-sync the thread and this will then show latest posts. Thanks, Mike.

Court or not?

    hoping someone can help me, short story, my mate has a bike but is on a learner permit. The permit is legit as is the bike ie catagory A, taxed & insured. He recently got pulled by the gards for driving on a motorway & no L tabard. my question is what is he looking at?

    He says he'll get points & a fine & that's it but I thought it was an automatic court appearance which he laughed at out of hand. I know he's been a fool but I'm trying to get him to consult with a solicitor but he's having none of it. Mods; if this post belongs in Legal then please feel free to move.

    I can only guess if these are summonsable offences but the correct thing to do is wait and see. If he gets a surprise from the post man he can talk to a solicitor then.

    The tabard is 2 penalty points. Can't find a motorway offence for learners in the penalty points pdf, can't link as on phone but search the RSA site for penalty points, so might be a summons offence.

    Best thing is wait and see as a solicitor will be needed if summoned, so no point in bothering unless they get summoned.

    A solicitor is a waste of time and money for an offense like this.

    Go to court (if it comes to that) and take a slap on the wrist.

    If he gets the penalty points notice in the door pay the fine and forget about it.

    Well they can only give one set of points when multiple offenses are detected together.
    He could get done for driving without due care and attention or dangerous driving.
    But best wait and see what comes in the post

    The offence is "Failure to comply with prohibitory traffic signs" which carries 1 point and €60 fine, or 3 points and €120 fine upon conviction.

    Bear in mind that contesting points can often see them doubled, and 7 PP on a learner is a ban.
