Tesco Store- Returning Mobile Phone

    I need advise on this.

    I have purchased a phone from Local Tesco Store. I have noticed it was slow and removed some apps. No luck
    Within 14 days period I have talked to Tesco Mobile. They have advised that if i have purchase device from online store I could return it as remorse period. They have referred me to point of sale.

    Store manager has refused replace or refund device. Manager has referred me to visit store and talk to different manager.

    I have purchased different product Amazon in past which was not my mistake ( Ordered wrong size phone cover). Amazon has accepted return of it without any hassle with pre paid label..

    Is remorse period is consumer law or each company has their return policy ?

    I think by 'remorse' you're probably referring to the 'cooling off' period which applies to mail order purchases, that doesn't apply here. You have to show that the product you purchased is defective or 'not fit for purpose'. If you're getting into performance then it's a grey area, they may claim that you installed too many apps on the phone and with the limited memory, what did you expect?

    Not saying that's the exact issue, just illustrating that your problem may be down to unfulfilled expectations which doesn't necessarily mean that you're entitled to a refund.

    To be fair Amazon is not a good comparison here, in general Amazon will go above and beyond in relation to returns and if an item is defective. Certainly alot easier to deal with then the vast majority of company's when it comes to defective items

    what did you buy and what were you expecting it to do and also what are you compairing it to..

    Ive often seen people buying cheap tablets and giving out that it wont do the same as an iphone

    If you buy online, you have a 14 day cooling off period as you are unable to inspect the item physically before you buy.

    If you buy in store, you have an opportunity to inspect the goods and decide physically if it suits you, so unless there is a manufacturing fault you have no right to a refund.

    I have purchased a Samsung mobile phone - 70 Euros. Model- SM-G318H.
    I agree performance of the device is subjective. I compare device to my older version Samsung Tablet. Phone is definitely way slower than tablet.

    I am not a tech guy. But it takes longer than 10 seconds open google app on phone. Less than 3 seconds on tablet. İt is slow compare my previous device. Nokia 520 .

    How can I prove device is not functioning properly. Honestly I believe there is a something wrong with device.

    It is functioning properly, it's just a bummy phone, it's nearly impossible get a decent smart phone under €60.
    You've no right to return in this case. Cut your losses, sell it on and invest in a good phone.

    Doesn't sound like the phone has any problem. Your only compairing a brand name. A new Nissan Micra wont be as quick as an older nissan primera for example. No doubt there's rights you prob have but in my opinion its your own fault for buying a cheap phone and not the retailer

    İt is a cheap phone and I agree I don't expect too much from it. Just read news and google. No games, etc.

    My comparison could be incorrect. In this case manager's view against my view. I am not sure managers are trained to diagnose devices.. Personally I didn't.

    My point is Tesco does not offer any solution, advise or help to their customer. Manager's advise go to different store.. Just trying get rid off issue..

    Overall thank you to everyone for advise and opinions. İt is just 60 Euro phone and I will not buy phone from local Tesco store anymore.

    I can see where you are coming from but they are doing no wrong, the fact you have now used the phone means they cannot resell it. They wont be able to claim it as a faulty from their supplier because there is no fault with it. The manager could be an IT specialist for all you know so Its not right to judge him just because he works in retail, alot of these people are actually experts. I'm pretty sure had you gone in and said I want a phone to do this this and this, the manager would have recomended something dearer and you would prob have taught hes trying to rip you off. Its a loose loose for tesco so I wouldn't blame them for not refunding it. If I were you i'd put it up on adverts and do some homework before your next purchase

    ANY smartphone under €100 isn't worth it's <SNIP> for anything other than calling and texting.

    benchmark the phone and compare to what it should be.
