Insurance - conviction under RTA - what does it mean

    I see in the assumptions of an insurer

    You have never been convicted of any offence against the Road Traffic Act

    If you received a fine from a guard for driving without tax , which you paid is this considered a conviction under the Road Traffic Act or is only a conviction when you appear in court.

    Were you summonsed?

    If it was just an on the spot fine that is not considered a conviction.

    Even if you were summonsed and convicted, it would not be a conviction under the Road Traffic Act, it's a revenue issue and is an offence under the Finance Act 1976.

    This is the offence under S.73 of the Finance Act 1976 for non-display, the official name for the tax disc is a 'vehicle licence'.....

    73.—(1) Where a vehicle to which this Part applies is used, parked or otherwise kept at any time in a public place, if while the vehicle is being so used, parked or kept there is not fixed to and exhibited on the vehicle in accordance with section 5 (5) of the Act of 1920 a licence which is both issued in respect of the vehicle and is for the time being in force, then the person by whom the vehicle is so used, parked or kept at the time shall be guilty of an offence, and in addition to the person aforesaid, the person (if he is not the person aforesaid) who on the day on which the offence is committed is in relation to the vehicle the relevant person shall also be guilty of an offence.

    There is a separate offence of not paying for the disc, I can't remember which act it's under (possibly the Roads Act 1920) but it's definitely not the RTA.
