    Hey! According to Threshold, if a landlord refuses a request for permission to sub-let or assign a lease, a tenant may terminate their fixed term lease.

    Does anyone know if this can be done without penalty? In other words, does the tenant retain their right to have their deposit refunded (given that everything is otherwise left in order)? Also, in such a case, would the notice still need to be given after the permission to assign was refused?

    RTA 2004 Paragraph 186 (2) If a landlord of a dwelling refuses his or her consent to an assignment or sub-letting of the tenancy concerned by the tenant, the tenant may serve a notice of termination in respect of the tenancy
    and terminate it accordingly.
