Hey, any help with topics for Equity...I am desparate.

    So far I have covered:

    Undue Influence
    Resulting Trusts (w/ Advancement)
Constructive Trusts (New Model and Strangers)
    Trusteeship
    Proprietary Estoppel
    Mareva and Quia Timet Injunctions
    Strong v Bird
    Donatio Mortis Causa

Does this sound like enough? I am seriously dreading this exam.

Do you know whether it appears as a PQ ever? I just have undergrad notes for it so nothing of use, sorry.

No its always an Essay question. Pretty straightforward. Would just like a sample answer as the manual isn't very clear

Tort - does negligent care of children / negligence on the roads appear much? Is it worth knowing as a sub-topic within Negligence?

  • Registered Users Posts: 1,901 ✭✭✭Gunslinger92

Last time it came up as a problem Q was October 2013. It's due a run.

It was a problem question in October 2016 aswell!

Maybe throw in charitable trusts if you have time? Don’t think it has come up in a few sittings

It was a problem question in October 2016 aswell!

Was it? Are you referring to the Tax Advisor Q? I thought that was a Professional Negligence Q rather than Negligent Misstatement?

Yeah that one. I have a manual yoke from one of those one day revision courses that a pal lent me, and the sample answer it gives discussed only negligent misstatement. My grid has it down as both though and the examiner report says it's professional negligence

Sorry :pac: I'm not gonna comment on topics I know nothing about anymore!! :o

haha I'm second guessing myself now. I was full sure it was just a professional negligence question but actually the grid I have says it's both as well.

I can't wait to get shot of this exam.

Does anyone have this problem/sample answer Q Oct 2013 on negligent misstatement? I only have past papers as far as Mar.'15 from the law society :(

I don't have any sample answers but can PM you the question if it's any use to you?

    Doubt it.

Does anyone have any predictions for property?

If a beneficiary under a will is a witness to a codicil - are they both invalid?

    The usuals!
SUCCESSION In essay form and Problem
    Adverse Possession
    Easements
    Co ownership

I passed property twice with just them and licences (Due to lack of time to study). I wouldn't suggest just covering them but I'd say you'd be very unlucky not to get at least 3/4 questions from the above topics.

I dont think they are invalid. I think it means the witness cannot get their inheritance but the will remains valid for all other gifts.

I was signed up to do 3 exams, Company, Tort and Equity.
I'm not sitting Tort and I didn't turn up at Company on Friday. I will just be sitting Equity this Friday. Does anyone know if there's any issue with not turning up? I only emailed the Law Society to let them know over the weekend.

    Property

Do you guys think I should be okay with just:
    -Succession Law
    -Easements
    -Licences
    -Adverse Possession
    -Co-ownership

I still have loads of study left for equity and don't really have time to cover another topic for property.
    Also,
    Equity

    Specific Performance
    Estoppel
    Tracing
    Trustees
    Express Trust
    Charitable/purpose trust
    Resulting Trust
    Undue Influence
    Rectification

Am I being really unwise by not covering injunctions ? I know they are a definite question but I just feel there is way to much study. Should I be okay with above without injunctions ?

If this is your first sitting...... don't bother turning up for Equity. Otherwise, there's no issue. They just pocket your cash ( as if they need it).
I didn't show up for one in October, and result marked ABSENT. You don't need tell them.

Can any kind soul shed some light on co ownership for me?

I thought I had it sorted today and then I looked at the March 2017 Problem Question One. :-/

Is anyone after working on this question/familiar with it that can shed some light on it for me?

It would be very much appreciated.

Hi All, I appreciate that EU was last week and eveyone is preparing for the remainder of the exams. For anyone who has EU under their belt, Im just wondering what your experience was with this exam in terms of how you felt you did, topics covered and results achieved etc. I felt the paper last week was ok and I was able to attempt five questions. I didnt do the case note. I dont usually dwell on these exams but as its my last one its on my mind and just hoping i did enough to get it. Any replies would be greatly appreciated

I was convinced I failed EU last sitting. I felt like I had little or no case law and just worked out the questions when I was in there and heavily relied on the legislation. It was my highest grade. I am sure you will do very well.

Not my first sitting, I've already passed 3 so I'm going to sit Equity.
    Thanks for that.

    I’m doing;

    Proof of Negligence
    Limitations
    Defences to an Action
    Negligence
    Professional Negligence
    Employers Liability
    Occupiers Liability
    Vicarious Liability
    Defamation
    Trespass to the Person
    Damages

I’d love to cut some out but don’t know which ones!

I'm doing all the same as you except limitations! Feeling very underprepared though.
A lot of the big ones didn't show last year - defamation, occupiers, employers, professional - so I'm really hoping we'll have a nice paper.

So I am doing Rylands V Fletcher and Nuisance etc.

    Sorry for confusion!

I've definitely seen it as a problem question on one of the papers before!
