Help needed regarding security deposit

    Hi All,

So a few weeks back we had to move out of our rented property due to the landlord selling the property. While it was very frustrating at the time, considering we were only there 4 months, we knew we would get over it.

We were in touch with the landlord about a week after moving out, asking about the return of our security deposit. We were advised we would receive it when all bills/accounts linked to the property were terminated. The gas account was still in its 30 day notice period so we had to wait a few more weeks for that to close. The gas account was fully closed and no outstanding payments about 3 weeks after vacating the property.

So that brings us up to yesterday when we sent a text to the landlord again asking when would we receive our deposit.
The reply basically stated that the landlord has "apparently" entered into a insolvency agreement and all her assets have been frozen and cannot refund us our deposit at this time.

The message itself was much longer, basically worded in a way that I feel would want us to feel sorry for her and be patient with the situation.

Each month we paid rent directly into the landlords account. However the deposit was paid to a letting agent.

Can anyone help with some info regarding the best approach to this situation?
Do we have any leverage that it went through an agent first or are we totally at a loss with this one?

Also I'll be more than happy to give more info if it may help in trying to find a resolution to this.

    Thanks in advance :)

Lodge a case immediately with the RTB- and apply for an adjudication.
If the landlord is in an insolvency agreement- without an adjudication- you don't exist.........
