Legal arguments essentially boil down to the fact that STB is now widely viewed as the preeminent expert on all things NZ rugby.

    :pac:

nah, just a rugby nerd :D:D

i could just as easily make a comment on the state of schools rugby in sri lanka :P

Former ABs halfback Bruce Dean's has died. Only 58 years old. A stalwart of the great Canterbury Ranfurly Shield side of the early '80s, he was the back up to David Kirk at the '87 RWC. Became the starter of one of the best AB sides ever for the next 2 years following Kirk's retirement. Younger brother of Robbie Dean's. His grandfather was a member of the 1905 Originals.

Six Nations Rugby filed a copyright claim against SquidgeRugby. 21 videos have been removed from his YouTube channel and if things don't change his entire channel will be deleted. A lot of work went into those videos. Thousands of hours.

I understand that the clips are Six Nations content, but surely there's room for people to use them for analysis and a bit of comedy. Sam Warburton has been full of praise for these videos too. Having said that, their IP is their IP. They can't allow one exception. Still seems like a backwards move though.

Terrible news, huge fan of Squidge's videos would hate to seem them come to an end over this :(

Has to come under fair use FFS

Is it fair use if it's generated as revenue for the user though?

I'm torn on this. He does promote the tournament but he is using copyrighted material to make money. Hopefully a compromise can be reached.

Are they going to go after, say, Murray at the42.ie? He uses clips in his analysis at times

I really like Squidge's videos and think he gives some really great insight and breakdown of things, but I think from the Six Nations point of view, some of his videos are essentially a highlight reel + analysis of games, which directly competes with their YouTube highlights and he's reusing their copyright material to do so, and making a profit from it without paying any royalties etc.

Murray doesn't monetise YouTube videos using the content, and the42.ie/Joe could have copyright agreements with the Six Nations to use those clips.

    Bingo.

They do monetise their own site, using that material. I used th42 as an example, there are thousands of publications doing such. Hard to imagine each having an agreement.

Also commercial interests can also fall under fair use
Satire, criticism, commentary, and analysis fall under such.

No one watches his videos for the clips, they watch them for the analysis, just that YouTube automatically sides with reporter vs creator.

YouTube is a completely different ballgame though, with a system designed to allow content owners to file copyright claims against people using their things with a click of a few buttons, by YouTube's definition of fair use, not the laws.

That's fine but then don't quote commercialisation or copyright in arguments supporting the strike, as they are not applicable. All that is applicable is YouTube's random application of strikes

It is though. YouTube allows people to use copyright material in videos under fair use, as long as you choose to de-monitise the videos and not take revenue from the viewership.

But the issue is Squidge was monetising the videos, and the Six Nations filed strikes against these for using their content.

I hope this is the correct thread to ask, can anyone tell me whether any of the usual satellite sports channels are transmitting the RWC France V Scotland warm up game this evening, please?

    It's on Premier.

And fair use allows for commercialisation as long as you are not just ripping off the product, so making money from it is not the issue legally.

The ussue is YouTube automatically siding, without proof, on the objector's side and not allowing for an adjudication before action.
There is also no penalty for spurious claims.

I'm surprised it took so long for Six Nations to object really. Pretty blatant infringement by a profit-making entity.

But no longer simulcast on eir sport since they separated. No way to watch unless you pay Sky €120+ p/m. There is no streaming option at present. If it doesn't come on to Now tv I might look into rugby pass. I have a dns service and I see it is covered but not sure if it can be chromecast.

Why would that matter? Fair use (in copyright terms) does not exclude commercial revenue. That's why satirical shows can happen, for money.

Second row interception and canter in, A rare sight but beautiful none the less.

Six Nations tweeted to SR to resolve it. I imagine something will be worked out.

Probably after Six Nation media guy logged into Twitter and saw hundreds of negative mentions :pac:

6Ns, and rugby in general, attitude towards content like this is so regressive. It's not competing with their products, it's complimentary. Increases interest, widens the pool of potential viewers, and offers a humourous way to understand the game.

They should be sponsoring Squidge's stuff, not trying to ban it. Idiots

People were using the contact details on the 6N site too

Rugby is a complex game, his videos have a funny and entertaining way of explaining the complexities of the game, it’s quirky to watch but based on some solid analysis.

His video on how Australia beat NZ is very interesting and showed some analysis that I would never have noticed.
The 6N should look to bring him onboard providing online content instead of banishing him. It’s an area that they have no exposure in anyway.

Found an excellent stream and it looks as though that's how I'll be watching much of my rugby from now on. :(

The Top 14 starts on Saturday evening but it looks as though no-one has informed Sky Sports about it as there's no sign on a live Top 14 game or a highlights show on their schedules - yet.

Clermont will be taking on ROG's La Rochelle on Sunday at 15.45 and I'd really like to see that one.
