No insurance vs Not named on policy.

    I wonder if those circumstances differ.

    Case 1.
    There is a car with no insurance policy attached to it. Johnny who doesn't have any insurance policy in his name, hops in the car and drives away.

    Case 2.
    There is a car with valid insurance policy purchased by vehicle owner. It's not open drive policy, and it lists drivers as policyholder and f.e his spouse and no others. Again Johnny hops in the car and drives away (he is not policy holder nor his spouse)


    What would be consequences for Johny in
    a) accident at his fault
    b) garda checkpoint.


    I'm sure that in Case 1 point a) a third party who suffered damage in accident would need to claim from MIBI, and MIBI would most likely ask Johnny to pay them back. Very likely Johnny summonsed to court for driving uninsured.

    In Case 1 point b) Johny would be summonsed to court for driving uninsured.

    But what about Case 2 point a)?
    Would vehicle insurer pay for damage to third party caused by Johnny. Or would insurer wash hands completely and direct thrid party person to MIBI for their compensation? Also if insurer paid out to third party, would they be trying to recoup the money from Johnny or vehicle owner/policyholder ?

    And finally Case 2 point b)
    Would consequences for Johny be exactly the same as in Case 1 point b)? Would he be summonsed to court for driving uninsured?
