Key fob missing - garage post it, I never got it.

    On Saturday the 6th I bought a car from the garage in Dublin. It was out of hours deal late in the afternoon. During signing the documents I was told there's a second key fob but dealer couldn't find it. Promised to find it Monday and send it to me by post. Fine by me.
    Called them on Monday the 8th to ask if they found the key fob. Answer was yes and that it's in the post. Two days later nothing arrived. Another call. Was informed that it was sent and should be with me soon. Waited till Friday 12th of Jan. Still nothing, called them again and same answer - it's in the post. Waited till Monday. On Monday the 15th I was told that it was posted on Saturday the 13th and if didn't get it yet I will get it on Tuesday. It's Tuesday and there was nothing in the post.
    At this stage it's obvious to me that I was lied about the second key fob. My understanding is that since garage promised second key fob it became a part of the deal. What are my rights ?

    Was it a main dealer or a back street dealer, it sounds like one of the latter.

    Unfortunately these type of operators are probably used of fobbing off (no pun intended) people, you could keep visiting them and hounding them but they may just give you excuse after excuse until you get fed up of turning up there. Not much good to you now but the time to really make sure all things are in order is before you buy the car, if it means having to wait on things before closing the deal and come back again then it's the best way in the long run.

    If you have problems getting a key from them then you might have a bigger battle on your hands getting them to honor the car's warranty. Not sure how you get satisfaction from these type of dealers to be honest other than pestering them for a while and then maybe through the small claims court?

    Not a main dealer but SIMI registered if that makes them better in any way.
    If he told me that there's no second key I'd buy the car anyway. It's an older car and had it checked and was happy to drive away in it. I don't like to be lied to thou especially by the sellers. I'm across the country from them so I can only chase them on the phone.
    Small claims court is an option.

    Ideally the keys should never be left alone with an address.

    You should let them know you don't care if there was a second fob that can't be found, and want to honestly know whether or not one was posted out.

    My money is on the dealer never actually got a second key when they bought the car from the previous owner and fed you a story about sending you a replacement after the sale to close the deal.

    BTW what model car is it as some only come with only one key fob while the spare key is just a standard key to open and start the car. Some Fords were known for this especially the Mk2 Focus.

    Really? And what do you expect them to say? Something like this maybe...

    "Sorry, there actually is no second key and we lied to you about having one in the first place, but since you asked nicely we are telling you the truth"

    Take your head out of the clouds.

    Got the key fob in question in the post today. It seems they mislead me with a incorrect information when it was posted.
    Given that new key fob is €400 from main dealership I'm glad I got it.
