Management company pocketing cash on top of agreed rent with landlord

    Hypothetical scenario here:

    Agreed rent with tenant through letting agency (includes x% amount in management fees) is €2000.

    Turns out the management company is charging €2500 to the tenant without telling the homeowner and is pocketing the €500 euro (for a number of months.)

    What rights does the home owner have in this scenario? Is this illegal?

    I'm confused. Are the "letting agency" and the "management company" two different entities here? And is this "management company" in the sense of the management company of an apartment block, collectively owned by the owners of the apartment, or is it an estate agency providing estate management services?

    The bottom line here is that there will be a lease signed by the tenant and by the landlord, or the landlord's agent, and that lease will state the monthly rent. What rent is stated in the lease? That's where the enquiry has to start.
