HAP rights as a Licencee (in an owner occupied property)

    Hi,

    Do Licencees in receipt of HAP in an owner occupied property have the same rights as a Tenant in receipt of HAP in a non owner occupied property.

    No- you are living in the property under licence- you are not a tenant- and irrespective of the fact that your rent is being paid under the HAP scheme- you can be asked to leave at any time- without any specified period of notice.

    Key to this- is it is an owner occupied property- and you are living in the property under licence- you are not a tenant- and tenancy law does not apply to you.
