Sale agreed but issues with planning permission

    We are sale agreed on a house and our survey has highlighted some planning permission issues and building regulation issues. The septic tank is closer to the house than allowed under planning permission and the shed does not have planning permission.
    In regards to regulation, 2 of the rooms would need new windows put in as the skylight windows are a little too far off the ground for fire regulations.
    This has us worried now. Our surveyor says they are not major issues. We are sale agreed on our own house so sitting tight for 3 or 4 months for retention is not really a runner. What's the best thing to do?

    Ask your solicitor whether this will make it impossible;e for him to certify "good marketable title" assuming that you are borrowing. If he cannot then your surveyor's views are irrelevant as you won't be able to draw down the mortgage.

    From the list of 4 issues that you have mentioned it will take several months minimum to rectify and probably a contribution to the local council also.
    We had something similar but were in the fortunate position not to be in a chain to were able to wait for the planning issues to be rectified.
    Not a hope a solicitor will sign off with that many serious issues.

    I think legally its 7 metres. The one in this house is for the than that, but closer than the 20 metres mentioned in the planning permission.

    Completely depends on the site and system designed.
