Additional items in my order

    I ordered a number of goods online. Received my order. But there was additional items along with despatch docket for items aswell. I rang the companies customer services and was told someone would get back to me. This didn't happen. I was going into town so brought these items with me and went into store ( don't know if I can name store involved). Explained to employee what had happened and was dropping off items As they weren't mine to keep.
    The response I got was I could send them back to the companies warehouse at my own cost or keep the items for myself free of charge. But they wouldn't take them from me? ive Since re emailed the company but no response either. I've emailed them all information from despatch docket so they know it's not mine.

    Leave them to sort it. It may well not be worth their while taking them back and booking in to stock etc.

    If they say keep them then keep them. If they want them back then they'll have to cover any costs.

    Is it clothes? Once you're not charged, I'd just leave it at that. Amazon regularly let you keep things FOC as its easier than picking them up.

    Depending on the company, the online and physical shops may be treated separate too and the shop may not be able to take back items from the online shop. I know it sounds like it should be simple, but it depends on how the company has things arranged.

    How much were they worth out of interest? and what sort of item?

    If the item cost them little it can cost a lot more than you think to get it back. The employee in the shop has nothing to do with their mistake, and might not want to have to take time out of their own schedule to solve it and do admin work. I have gotten quite a few free things in work sent there in error and told to keep.

    I got a womans t shirt recently sent from amazon, meant to be a mans. I expected them to tell me to keep it but they wanted it back. Was about £10 worth. I returned it and got a refund, no correct replacement was offered. I only ordered it to bump up my order over £25 to get free postage, so they might have made a loss posting another on its own.

    If you've let them know, they're effectively yours after 30 days if they don't take them.
    And in fairness, you've already gone out of your way to try to give them back.
    47.—(1) Where—

    (a) unsolicited goods are sent to a person with a view to his acquiring them and are received by him, and

    (b) the recipient has neither agreed to acquire nor agreed to return them,

    and either—

    (i) during the period of six months following the date of receipt of the goods the sender did not take possession of them and the recipient did not unreasonably refuse to permit the sender to do so, or

    (ii) not less than 30 days before the expiration of that period the recipient gave notice to the sender and during the following 30 days the sender did not take possession of the goods and the recipient did not unreasonably refuse to permit the sender to do so,

    then the recipient may treat the goods as if they were an unconditional gift to him and any right of the sender to the goods shall be extinguished.
