Non refundable deposit on build

    Bit of an unusual one.

    Buying a one off house (it's a ruin currently) from a builder. He had already poured concrete when we met him and gave us a fixed price for the overall job. He also said if we got in early we could make changes to plans. We were given the current plans and tweaked little bits here and there, never met the architect but each time we got plans back he seemed to make mistakes and his original plans were inaccurate including overall floor space, where the roof could support skylights etc.

    Fast forward to now, planning permission (submitted by builder) won't be back for 5 weeks and builder wants 10k now to cover architect fees and his costs (we have had several meetings with the builder but not architect). There was never any talk of this before. The 10k is coming off overall house price but is non refundable. As planning isn't even back is this just crazy? We feel we could lose property if we don't pay it.

    Why is your builder doing things like pouring concrete if you don't even have PP? Is that normal?

    Run away now. The builder has started without PP in place, and you have serious doubts over the architect.

    Op, is there planning on site for original design and is new submission for the changes you want made? You could lose property, but then again that might not be a bad thing, looks a bit messy.

    Not supposed to start before the commencement notice - ask the builder to meet the architect, see if there is one.
    Who's doing the project management? Is it the builder?

    Sounds dodgey to me op. Builder could be taking you for a ride here.

    If there is no PP in place, do not hand a cent over.
    Have you signed any contracts?

    Do not pay a non-refundable deposit. Do not pay any deposit before consulting your solicitor. This wole thing is madness. Once the builder has you involved, the price will go up and up. You will be throwing good money after bad. This whole thing can only end in tears.
