Being let go if somebody hired after you is kept on

    Hi all,

    Hoping somebody might be able to shed some light on this one. I've become aware of a situation where somebody has been let go from their job but another employee hired after them has been kept on. The reason given was lack of work. Neither of these employees would have been in employment for 12 months.

    My question is regarding the legality of this. If there is a lack of work for one employee, is the company obliged to follow a "last in, first out" system or can they just choose who to let go?

    There must obviously be some reason behind one employee being retained over the other but if there was a performance issue or anything like that, you'd think they would follow some procedure rather than hiding behind this.
