landlord with holding deposit

    Just abit of background, my daughter rented a room afew months ago which was owner occupied. As she changed jobs quickly she needed to move giving Landlord one weeks notice. Her landlord refused to return her deposit (130 euros) saying that he saw many others with a view to letting the room and that he was annoyed she only stayed 2 months and messed him around . My daughter is very annoyed and wants to go to a solicitor or report him to PRTB and Revenue, her Dad said that because the landlord is probably on the rent-a-room scheme she may have no comeback. Are there any further steps that might be taken?

    She has moved back home now, its 3 months after the event but understandably she wants her deposit returned.

    Was there a Tenancy Agreement in place?

    A solicitors letter will most likely cost as much as the deposit so is it really worth it? What was the agreement with regards giving notice? Did she give the adequate amount?

    There was no tenancy agreement, it was just on a week to week basis so there was no discussion about length of notice required.

    Has she left yet?

    She needs to talk to him and not leave without it if still there.

    Maybe offer a small amount towards re advertising.....

    Small claims court deals with this, no need for solicitors etc.

    If there was no contract in place (written or oral) in regards the length of stay, you should be successful.

    It’s not a tenancy and he was never her landlord so she has no rights. It’s only €130. Solicitor will charge twice that for just putting pen to paper. Forget it and move on.

    Or call round to the house and look for it back - 130 quid is a fair amount to someone with nothing.

    She shouldn't have left without it but it seems a very low amount for a deposit.

    Its probably one weeks rent. She gave one weeks notice. Is it really worth bothering about?

    A deposit is given in the event of breakages, and damage to property, if this is not the case, she should have got her money back, Did she keep up to date with her rent and bills while there, what term did she say she would stay for, if she broke that, then it is a different story, I guess
