Employer ignoring Display Screen Equipment Regulation

    Hi everyone,

    So I work as a contractor through a company at a software company where I have to look at screens all day (computer and phone). I've been working for them for more than 3 years now and not once did I get told I had a right to an eye test and they also have never done a workplace assessment (they have never even come in to the office in fact). I have emailed them loads of times about it but nothing has changed (mind you, I even mentioned I have sore eyes and elbows from work but not a single f** was given).

    Anyone any advice on how to proceed? Do I just go and get an eye test done myself and send them the receipt to pay me back? Can I somehow force them to come and do the assessments? Any point in dragging them to court over refusing to follow the Display Screen Equipment Regulations?

    Like any complaint environment, email and reference earlier emails about your concerns, then escalate to superiors before you go nuclear. Otherwise should you end up in court, you've a record of non-compliance by your employer

    I think Eye tests are free when you have PRSI contributions made. Check up online

    I’m sorry but why would they need to pay for your eye test or your sore elbows? I’m I missing something here? Court???

    Are you a contractor or an employee?

    Contractors do not have the same rights as employees.

    Specsavers do a full eye test for between 5-15 euro.

    With prsi it's free.

    You're a contractor not an employee. There is a difference.

    It's your (or your umbrella) company that needs to sort this, not your client (the software company)

    Am I entitled to an eye and eyesight test?
    The employer must inform employees that they are entitled to be provided with an appropriate eye and eyesight test, which would be carried out by a competent person. The employer may do this in a number of ways including the following -

    Consultation with the safety representative(s) and formulate a memo to be placed on a notice board,
    Inform the Human Resource manager/specialist and request that they inform all relevant employees of the availability of such tests,
    Inform the employee while carrying out the analysis of the workstation,
    Other appropriate means of effective communication.


    Who is entitled to eye and eyesight tests?
    Every employee who habitually uses a VDU as a significant part of normal work has a right to opt for an appropriate eye test and an eyesight test which must be made available and paid for by the employer.

    You’re a contractor not an employee therefore your company not your client is responsible.
