Retention planning permission

    If an existing farm steel shed was built without planning permission and is over seven years old, can the planning authorities require that retention planning permission be applied for?

    Yes, regardless of how long it is there, it's unauthorised and retention permission will be required before a further grant of permission will be granted..


    The 'seven year rule" relates to enforcement, meaning the Planning Authority cannot pursue an enforcement case against said development.

    No they can’t require you to make an application for retention.

    Once they realise that’s its over 7 years in place, they will not proceed with any enforcement procedures.

    But beware, that any future searches on the property will show the enforcement file open and it may stop a sale because the site is in a state of non planning compliant. This also means that all other exemptions cannot be enjoyed.

    Are you sure shed is not exempt?
    Ask a professional or apply for a declaration 5 cert from LA.

    Not point making a section 5 Application with a professional.
    The professional in question should be able to work out if its exempt and issue an Opinion on Compliance with the Exemption Regulations himself.

    Agricultural shed is planning exempt if under 200sqm and more than 10m from a public road and more than 100m from any neighbours buildings. So I'm not sure why you would want to get planning for it.

    Maybe its over 200sqm, closer than 10m to the road and closer than 100m from the nearest neighbours dwelling?

    You'd apply to get a seperate esb connection.
