The Company my son worked for over an eight year period went into liquidation .
The Liquidator took it on himself to apply for statutory redundancy for the few employees involved .
The application was entered 7 working days too late .Ie 7 days outside the year allowed to claim .
The liquidator was not aware of a time limit of a year for making the application .The workers have lodged an appeal with the WRC.
One of the workers has been informed of a date for his appeal .The other two are not being heard for another few months .Surely the one appeal should cover all the workers .
Do the workers need to have costly legal representation at this appeal .If so surely the one legal firm should be able to cover all on the one day .
Is the Liquidator liable for professional negligence if this appeal fails.
There is a full paper trail of all correspondence .The Liquidator stated he was hampered by non conformance with the company directors which caused delays in processing everything .He said he was never once advised by revenue of a 12 month time limit on statutory redundancy applications following company wind up.
Thanks for reading this and hopefully somebody has a few answers.
