Is there a cooling-off period after refusal by ABP?

    Say you submit an application for PP to DLR co. co., there are a few objections but the council grants PP. One of more of the original objectors lodges an appeal so it goes to ABP who overturn the PP.

    1. How long after can you submit a new (or any) application for the same site/property.

    2. Does the new application have to be substantially different from the original (refused) application?

    If the answer to Q2 is 'yes', then....

    3. If you're determind to build according to the original plans, is there a longer cooling-off period, following which you can resubmit the original application?

    1. You can submit almost immediately, as far as I know. The only rule I think, is that you can't have 2 applications at the same time. Once it's refused by ABP, it's finished so you can start again whenever you wish.

    2. Not necessarily, but you would be a fool not to address the reasons for refusal as the refused application will form part of the planning history of the site and will be consulted in any future applications. If you are refused because of reason x and you resubmit without taking measures to address x, then you may as well burn your money.

    3. Again, no cool down period AFAIK. But again, no point submitting the original application if you don't alter it to take account of the reasons for refusal.
