Salary Negotiation/Payslip Request- GDPR

    Hi all,

    1st time poster. I've been offered a role within a specialist/niche field.

    On the advertisement a salary range of 10,000 was advertised. I accepted a verbal offer after explaining my salary request was at the top end of the range in-line with industry standards and experience levels.

    The company itself have said that in order to consider paying me the top end of their range:

    "If a candidate can provide evidence that their current base salary in a similar role is higher than what we are offering the we will match this and put them on the next point. For this, we receive proof of your current salary either through a payslip from your current employer. This policy is implemented across our organisation at every level"

    Surely this is some infringement of GDPR to be requested this private information in order to negotiate salary?

    I have decided not to take the job as they have been messing around for weeks re: Salary an it just seems a bit dodgy to me, but i'm just wondering could anyone advise on this- or have they seen anything of the likes before?

    They're asking you for info. It's your choice whether to give it.
    There's nothing related to GDPR here.

    That is a fair point- but does it not fall outside the scope of a reasonable request considering purpose limitation in terms of GDPR? I could be mistaken, but it seems like a particularly odd move for a salary negotiation.

    No, they are asking you to voluntarily provide it, so your consent is sufficient for GDPR purposes.

    They say "show us proof and we'll match it"

    Unless they're collecting this info for other reasons not stated, or are going to share it, or keep it for no reason, there's no GDPR breach.

    Seems absolutely reasonable to me. I don't see how you are bringing GDPR into it, you're only sharing information about yourself and would be doing so voluntarily.

    Time to break out the PDF editor :)

    They surely can see it from your tax information once you join anyway? I always thought companies would look at your P45 to see, but that now has changed since P45's are gone.

    I wouldn't chance it, it definitely would only come back to bite me in the end!

    Understood- I was barking up the wrong tree, just thought it was an odd request.

    Why not just show them your wage slip and tell them you are not taking the job unless you receive the top end of the salary they are offering? Why the need for cloak and dagger tactics?

    Your current salary is none of their business.
    Just put it to them that you are willing to work for' X' and let them decide whether they want to pay you that.

    Had something similar in a job interview a couple of years ago.
    When we were negotiating salary the HR lady kept asking my current salary, she asked about 4 times. I refused to disclose it and instead just told her what I wanted for this role.

    As it happened I knew they were having difficulty getting anyone and what I was asking for was well in excess of my previous salary and she probably knew that.
    I got the job and I got the money I asked for.

    It's an odd request by the company I think.

    Your previous salary should not have come into the equation. Your job title, experience and references would've been more important here.

    Good on you for sticking to your guns.

    However, that's unless you falsely said you were previously on X salary - Then I wouldn't condone lying.
