Joint tenancy

    Hi,

    In the case of a joint tenancy of a privately rented house:

    If one of the tenants wants to leave when the yearly contract is due for renewal can the other tenant automatically stay on in the house under a new contract, assuming full rent amount continues to be paid?

    Or is the case that the landlord can now refuse to renew the contract as conditions have changed - therefore resulting in both tenants having to leave the house?

    I believe the tenancy still exists (no new contract/lease required even) but you need to inform the landlord of the change of who is living in the property:

    When a tenancy exceeds 6 months, you automatically gain Part 4 tenancy rights so there is no need for a new contract when the term on the one you signed runs out. The contract usually states that the tenants are joined and severely liable for the rent, so if you leave, either another tenant moves in to replace you, or the remaining tenant has to pay the full rent. Usually the remaining tenant gets someone else in to share, but does not have to leave.
