Landlord Wants to Backdate Lease

    Hello there, the landlord of a friend of mine wants to backdate her lease for her new apartment to 2018. One of the 3 housemates has been living there since that date. For what reason would he want to do this?

    My best guess would be that it's something to do with rent increases in a rent pressure zone. Could anyone shed some light on this matter, please? TIA.

    Has your friend a separate lease agreement with the LL, or, was he/she replacing someone who was renting under the original lease?

    A separate lease AFAIK! Her room was vacant from April - July. Only one of the 3 housemates has been renting the property consecutively since 2018.

    It depends whether your friend is renting the room or the property. If the other house mates are on the one lease and your friend simply replaced the tenant who left the lease runs from when the longest person is there. That’s the normal situation.

    So each of the 3 housemates have been asked to have their leases backdated to 2018. They each have their own lease for their individual room with the landlord.

    If they are renting a room from the landlord and not the whole house then they obviously can't backdate the lease to before they rented the room. Just tell your friend to refuse.

    That's her plan, but why do you think he's asked them to do this? So that he could potentially increase the rent by 8% next year? Or is that how it works?
