He hasn't incriminated the FBI. There is no confirmation that the FBI had the drive until Delaware police handed it to them. If they did indeed have it a year ago, based on the fact multiple news outlets passed on it, the most likely possibility is the emails are fake.

Why exactly would they making any statement if there's nothing to it? It would more likely be negative for them to comment this close to an election.

He's not assessing a witness for a trial though his lawyer was sent evidence of a political opponent's potential crimes and he was satisfied after verifying it on it's own merits.
