Commencement Notices Lodged During Lockdown

    Guys,

    There's always questions around this and its going to raise its head in the next week or 2 with construction restrictions easing.

    S.I. 156 of 2021 - BUILDING CONTROL (COMMENCEMENT NOTICES) (RESIDENTIAL AND CHILDCARE SERVICES CONSTRUCTION) REGULATIONS 2021
    Where a person has given to a building control authority a
    commencement notice under article 8 of the Principal Regulations which
    relates to a residential construction project or construction activity relating to
    early learning and childcare or school aged childcare services, during the
    period from 3 December 2020 to 28 March 2021 and the notice is valid, the
    period of time referred to in that article within which to give the notice does
    not apply, but the works or the material change of use to which the
    commencement notice relates may, subject to any restrictions or prohibitions in
    regulations made under section 31A of the Health Act 1947 (No. 28 of 1947),
    commence not later than 14 days after 12 April 2021.

    Basically this piece of legislation is stating that all Commencement Notices lodged for the above are valid once works commences before 26th April 2021.

    Makes perfect sense to be fair.

    The only problem is they could have let everyone know they were going to do this a few weeks / months ago so that people could have been working on their commencement documentation rather than having us all advising our clients not to lodge because the two weeks would catch them!

    They could indeed. They didn’t even let the local authorities know either!

    they also could have just "flicked the switch" and accepted all previously submitted CNs as valid.

    ive had to go back and change 2 CNs that were held as "revised"

    DCC validated them as they were lodged I believe.
