Rubbish being dumped on private land

A friend of mine has a field at the back of his property which he owns. The houses bordering the field regularly dump rubbish into the field. Sometimes it's just grass clippings but on other occasions household/building rubbish. What recourse does my friend have to stop this ?

None. Hence it being a massive issue. Contact the council and they'll take it away (I know it's private land, but the council, or at least Louth and Meath Councils, will take it away if it's illegally dumped there).


He could install CCTV and such, but he'd be wasting his time. Might get some luck by calling into the houses, or sending a few letters, but the kinda person that's dumping isn't the kind to be bothered.

I'd put up one of those fake CCTV cameras in obvious areas. Looks the part for ten or fifteen euro.

Here in Wicklow, land owners in those situations (adjacent to estates) have received warnings from the council that it is their responsibility to prevent dumping on their land and so they initially have to put up signage and then consider restricting access, if the signs don't work.

This is so wrong headed. No wonder the country is in shyte with people who don't care or too mean to dispose of the crap they generate.

In this case it's obvious who's doing the dumping as they are just throwing over their wall so the waste aligns with each house.

Throw it back into the corresponding house or put up a cheap chicken wire fence on the wall of each offending house about 3/4ft erected on his field’s side.

Yep. Its the same in Clare. Back about 6 years ago I got a letter from the council about rubbish being dumped on the road frontage of a field. The land is about 6ft below the level of the road and Sitka spruce are growing there. There were fines of up to 250k I remember. Didn't ever hear of anyone getting fined. In the end I cut my way in and bagged the rubbish and left it at the gate. There were 2 calf(i assume) skeletons in bags as well. The council took it away.

The dumping stopped for a while but now one resident is continuing to dump. My friend has witnessed this & today I actually saw a neighbour tipping rubbish over their fence & onto my friend's land. At the time of my OP I walked along the boundary & made a video recording. I made a second recording today & it's clear that this individual is dumping. The waste includes bleach containers, paint tins etc & a huge amount of newspapers.

Would there be a case to take, via the small claims Court, to cover the cost of getting the rubbish removed ? Would a Court be able to issue an injunction ? The neighbour clearly has no intention of stopping & is aware that the situation is being monitored.

The neighbour is an elderly man who may have some mental issues. He waited until he thought that I was out of sight & then threw rubbish over the fence, not realising that I could see him. Throwing it back will just result in conflict & a tit for tat. My friend isn't physically up for a conflict, lives alone & they could be seen as being in the wrong.

Is the OPs garden a public place? posts from the OP mention the presence of a fence.
