Estate not taken in charge

    A family member is in the process of purchasing a house and it seems the estates maintenance has never been taken in charge of the council. The solicitor believes that at the time in the mid 90s the developer agreed to take responsibility for this. However said developer fell victim to the property crash and no longer exists.

    is this a dealbreaker or am I correct in thinking it’s not such a big thing?

    Its not a dealbeaker but if someone is already very close to the edge, lending limits wise, the bank may decide not to let them borrow for it as non-managed estates can be problematic.

    Generally, councils and Irish Water provide some level of service (lightings, roads and drainage) for those estates that aren't taken in to charge, with the residents association taking over the landscaping - which in many council areas they need to do anyway.

    Poke around to see if the council is giving coverage for what they would do if it was taken in charge. If the estate has dead lighting, unfinished open areas and standing water - run.

    This time there’s no mortgage involved but the solicitor is concerned selling it in future could be difficult
