My local supermarket usually has a handful of people walking around with no masks on or the nose exposed.

The people without masks can be seen walking though the door without being asked if they’re exempt and the people with the nose exposed aren’t questioned either.

I walked around with my phone in my shirt pocket recording around the shop. I am considering using this as evidence to make a report to the HSA.

I have already made several complaints about business ranging from chippers, to supermarkets to bookies and I will continue to do so.

Why? Just avoid them? One of my favourite pubs refuses to enforce the guidelines.

We’re you given permission to film in the business premises? What about GDPR and and an individual’s constitutional right to privacy, plus their rights under European Convention on Human Rights. What is the penalty for illegally made recordings being passed to a third party?

If you have engaged in criminal behaviour, will the HSE be obliged to pass your recordings and details on to the the appropriate authorities?

Do you know what GDPR is?

A supermarket is accessible to the general public and as such you have no expectation to privacy there.

You can film in public if you are capturing a crime. In this case, not wearing a mask (without good reason) is a crime.

Seems like you’ve a limited understanding of GDPR obligations. The business that you’re filming in has an obligation in respect of personal data captured on their PRIVATE premises (even if done so by a third party) Personal data is information that relates to, or can identify you, either by itself or together with other available information. Personal data includes

• CCTV footage
• Audio-visual or audio recordings of you
• Location data

Now, Lets hope that you sought permission from the business owners to film on private property. Although it is open to the public, it is not a public place. You can be asked to leave at any point.

It could turn out that you are the person committing crime.

I would agree that this variant cannot really be stopped. It will peak and die out due to lack of available hosts. Restrictions are only having a minimum affect.

You should definitely follow through with the complaint you outlined. There is no GDPR concern here as you are not collecting personal data on people.

I find its more the smaller business that are the bigger problem. Since they are more familiar with the community, there is a lot more "ah sure its grand" type attitude relating to masks

I was buying a few items in a small fruit & veg store before the Christmas and another person entered the store shortly after I did. This person was clearly friendly with the elderly gentleman who owned the store. Not only was the owner not wearing his mask but the customer removed his mask to have a chat. Which carried on even while I was paying. I reported the incident on the HSA website. And continue to do so when I see breaches in other small business.

The attitude to public welfare on this thread is poor enough actually.

it should be security… a couple of extra security guards earning 14 euros an hour will have no tangible impact on the bottom line.

anybody maskless is prohibited from entering the store.

anybody who is maskless inside is given one opportunity to mask up, they refuse, no debate, they get directed to leave and any groceries they have are not processed…

I’ve not reported anybody as fortunately I’ve not needed to / had the opportunity to.

No, even though I'm vaccinated I will not darken the doors of anywhere open to medical apartheid. It's been established that covid effects people who are vunerable and to shut healthy people out of amenities and services is downright insane.

People with boosters can walk in willy nilly and cough and shout the night away, but a healthy person who isn't vaccinated is discluded. I'll remember the side of history I was on when all this is over. And I will sit it out until the passports are scrapped and history.

I know someone with symptoms that was going around the place without a care in the world. Shops are a risky places and if you can't get a PCR test, what then? Head into a shop or two and buy the antigen tests. They're not all being sensible and buying tests to have at home either.

Shops are very risky. It's any wonder we have 20000+ cases a day when no one cares and tells the op to ignore what's going on in front of him. Should they ignore pedestrians crossing at lights as well and run them over? You know, who cares if they end up with broken ribs or whatever.

Apartheid discriminated against people based on who they were and things they had no control over.

Vaccine passports “discriminate” (and rightfully so) against people based on the poor choices they make.

I understand your frustration and anger at non-compliance in many businesses and shops, OP - my local chipper has a few Eastern European people working there and most don’t wear their masks properly or at all. I had been thinking myself of “shopping” them to the authorities, but in reality what would that achieve? More antagonism, suspicion and bad feeling and there’s more then enough going around with Covid and its impacts.

I just go to another chipper now where the staff are fully compliant.

I think with the degree of contagiousness of the Omicron variant that most of us will catch it and get some symptoms - but those vaccinated and with their booster (like me and my OH) should get lighter effects.

The PPE, mask wearing and social distancing measures were never about stopping the virus - just slowing it down enough for our inadequate health system to cope with the numbers.

I was in one chipper where a lady behind glass had a mask on her chin. Not covered mouth or nose.i thought it so funny i laughed my way to a different chipper

Filming people is personal data if they are not wearing a mask.if they are wearing a mask and not recognisable it does not breach GDPR.

The supermarket is a private place and can stop you filming. I understand they cannot take what you have already filmed. It may be different now though

Someone said recently on the legal forum you cannot film people even in public now, some European thing. Not sure if true

You can film in public, ie security cameras. But as the data controller your details need to be available and they have the right to request a copy of their data

Same with dash cams. You technically need to display that you're recording
