Buying House from Seller Abroad

    Hi There,

    I am buying a house from a seller who currently lives in New Zealand, and want to complete the sale by using a power of attorney to his mother or mother-in-law.

    We asked them to sign the contract before a notary wherever they live, and send it back by courier but they are hesitant and delaying their reply on our request.

    My question:

    Is it safe to buy a house, with POA on the contract, not the owner without witnesses?

    What are the complications and risks that might appear later if we proceed as they want and accept POA signature?

    The Power of Attorney should have been witnessed by a notary in any case. Sounds like a scam.

    Whether it’s a power of attorney or a sale contract it would need notarisation and apostille process in NZ either way. The advantage of POA is that this can be obtained at the outset whereas a signature of documents would have to wait for the whole process to be finalised followed by (probably) couriering the Law Soc sale docs to NZ and (certainly) courieringvthem back to ireland post notarisation/apostille. In either case you are placing reliance on the foreign notary to verify identity.
