Taking legal action against estate agent for tenant contract breach?

    Hypothetical scenario

    You own a property and avail and entrust the services of an estate agent with the sole responsibility of renting out of that property.

    If there are contract breaches like non payment of rent or breaches of the termination notices, could you sue the estate agent to recoup your losses ?

    Renting and managing are two separate services and two separate fees. Renting is finding a tenant and no more You would need to check your management contract.

    No, They would be managing the property for you and not paying you to rent the property. The breach of contract would be between you and tennent who would sign the contract.

    No estate agent would sign a contract that you describe.

    You can get insurance for what you want though, Expensive but probably worth it.
