Virgin Cancellation Fee question

I've had Virgin Media for a few years, I'm thinking of upgrading my package, I see it says the new option has a 12 month contract. I also see there's a cancellation fee of €150. My question is whether this cancellation fee applies to me now (even if I don't upgrade), having been with them more than 12 months at this stage?…

Or by upgrading, am I accepting a new possibility of paying a cancellation fee?
