Over the limit drink driving

My friend was caught over the limit, taken to Garda station and provided his breath sample. This was over the limit , Garda said it’s ok , €400 and 6 month disqualification.

however he still is awaiting a letter from the Gardai or is it the RSA , my question is I’ve been told is he can still drive until he receives the letter and pay the fine? Is this correct

I seriously doubt it. I also really wouldnt risk it either until full clarification is made.

The disqualification doesn't come into force until he pays the fine, accepting the penalty.

BattleCorp, that is incorrect. When you are sightly over the limit, you can take an 6 months ban without going to court.

Is it not 15 days after the conviction?

If he hasn't recieved the FPN yet or appeared in front of a court ( depending on BloodAlcoholCount ) then he is I presume assumed innocent until such time as they accept their guilt either by Payment of the fine on the FPN or conviction by a court.
