    Hi all - Before approaching SEAI, would anyone have advice / a view on the following:

    A Developer is preparing Tender Docs for a block of 30 apts

    Does the Local Authoirty require a published Provisional BER for each Apt or is it acceptable that the Dweling Report generated by DEAP is sufficient ?

    If the Developer sells the Apt block in total to a Housing Association on Completion - then a Final BER Cert is published for each Apt at that that time - would this eliminate the need to have a Provisional Ber Cert prior to construction - if the Dwelling Report was sufficient for the Local Authority ?

    1. If you're referring to what's needed for a valid commencement notice, in my experience most local authorities accept DEAP / Part L reports. Some require a cert published.


    2. If the developer is offering the apartments for sale "off the plans" then a provisional BER is required.

    If the contract is only for the housing association to purchase on competition, then only a Final BER is required.

    Either way, you'll have to do as the solicitor for the purchaser requests.
