Departure time v Pushback

Hi Guys. Had a flight on the 14 Jul with vueling BCN To Dub VY8722. Original dep time was 19:10. There as was issue with the AC so the flight kept getting delayed until eventually they decided to get a new aircraft. ,A mad scramble to get us onboard the new plane with the 5 hour refund window approaching. Sitting on the plane and there is an issue with the cabin lights switching on and off and going full brightness etc.. They kept rebooting the system but the same issue until they decided just to go with it . We didnt pushback until 12.18 but on the vueling website they have it marked as departing the gates at 12.08, convienently 2 minutes under the 5 hour window for them not to issue a refund.

What are my options here as they are clearing lying about the departure time?

I thought the window was 3 hours?

Seems to be 3 hours for compensation.

5 hours for flight refunds.

You might not get a refund but you could probably apply for compensation.

It's arrival time at destination that matters for compensation, not departure. Compensation window opens at 3 hours.

I wouldnt be surprised if they tried to fight that. When we got to Dubin there was another plane at the gate so we had to wait 40 mins for that to move bringing us well over the 5 hours. If we get the compensation from them I'll be happy enough

It's 3 hours though!! Check the arrival time though the actual time that matters is doors open, not landing time

Vuelling are the Spanish Ryanair. My wife has had plenty of problems with them over the years and they've made it difficult to make complaints and look for compensation.

I'm sure you can try but it is not going to be easy.

Thats doing a disservice to Ryanair, they are far worse. Zero communication from them the entire time and a €6 voucher to get food & drink. It wouldnt get you a half a bread roll in the airport! I have put my request in and been given a case number so will see what happens, im sure many follow emails will be needed 🙄

My Ryanair flight was delayed by over 3 hours on a Friday. Put in the claim that day, approved Monday and had the money Wednesday, no dispute.

It’s arrival time, not departure time that counts. It’s why they always say a 1 hour flight takes 3 hours

Doors open is the the time the clock stops ticking, not the official arrival time.

How do I prove door opening time?

I was delayed from Manchester to Belfast today. As you can see it landed 2 hours and 59 minutes after scheduled.

Doors didnt open for another 5 minutes. Im afraid theyll say the landed time is what counts and i cant proove door opening time.

You missed the point. The official arrival time is the time the booking date. If the plane is due to arrive at 9, it’s only after 12 you’ll get an EU261 payout

Yes but my point is that if the official arrival time is 12 and you officially land at 14.59 you can still qualify because the clock keeps ticking until the doors open.

Mine was Edinburgh so 3 hours. Interesting though that the reason for our delay was that the aircraft was given to a Morocco bound flight, think their delay would have been under 4 hours if they'd waited, unless there were expected delays on landing

It would have been cheaper to compensate everyone on the Edinburgh flight than the Morocco one due to the distance involved...I think.

Yes but if as above, the delay before compensation kicks in for longer flights is longer, they should have been able to avoid compensating anyone. Plus I sincerely doubt even 50% of the people on our flight knew they were entitled to compensation though I did my best to tell as many people as I could.

Also note that I had an experience where Ryan Air literally lied about the total delayed time but it was confirmed using this site:

You can also use this company to manage your case with Ryan Air if they give you any grief:

They charge your 30% commission but this can be worth it if Ryan Air try to contest it
